Spend a day to find out about the impact of the new works constitution act in Germany from August 2001

Major alterations in the recently passed works constitution act will have a major influence on the cooperation of the works council and the company. Some observers consider the law a major step towards an improved representation of the employees in the company.

For others the new law merely results in increased cost and bureaucracy. For executives supervising employees in Germany the facts have to be pinpointed, the legal requirements have to be met and the implications on the companies have to be analysed. This will be the focus of this one-day compact workshop.

The following topics will be covered:

Adapting the works council structures to the new law

  • Branch and branch office works councils
  • Company-wide works council

Easier set-up of a works council

  • Simplified election procedure
  • Protection against dismissal for the initiators of the works council election

Recognizing hired help or persons with special employment conditions

  • Right to vote for persons on a job leasing contract
  • Employer's obligation to inform the works council about all persons on job leasing contracts

Improved working conditions for the works council

  • Reducing the borderline employee numbers determining the number of works council members
  • Increased release of works council members from regular duty
  • Introduction of partial releases
  • Providing the works council with up-to-date information and communication technology as essential work tools
  • The employer has to provide experts with the essential know-how on demand of the works council
  • Work groups can be established and codetermine on behalf of the works council
  • Increased release of works council members from regular duty
  • Codetermination in the job transfer of works council members

Increased works council rights in securing employment and improving employees' qualifications

  • Works council co-determination for group work
  • Increased co-determination rights in individual staff movements and alterations in the operation
  • External advisors can be enlisted to support for all alterations of the operation without previously agreeing with the employer

Integrating environmental protection at work into the works constitution act

  • Works council right to be informed and consulted in all matters of environmental protection at work
  • Employers obligation to inform about the environmental protection at work

Learning Objectives

The participants get to know the essential alterations of the law and learn how to cope with it. They will be empowered to transfer the alterations successfully into their daily routine.

CEOs, Branch Managers, HR-directors and other executives supervising employees in Germany. The number of participants is limited to 20 persons.

Registration Fees Tuition?

The workshop fee is EUR 750,- + 16 % MWSt. The fee includes comprehensive bilingual English and German course material, lunch and soft drinks. Participants who post one month before beginning oft the workshop, will receive an early book discount of 10 %. Further 10 % fidelity rebate receives users, who already participated in the year 2003 in one of our seminars. If several participants of a company announce themselfes at the same time, each further user receives a colleague discount from 10%. The log-on can be taken back free of charge until two weeks before beginning of seminar. Afterwards a spare part taker can be designated.
